According to the Office of the United States Trade Representative (<\/span><a href=\"https:\/\/ustr.gov\/about\/policy-offices\/press-office\/fact-sheets\/2026\/july\/fact-sheet-ustr-section-301-action-response-failure-60-economies-ban-imports-produced-forced-labor\"><span style=\"font-weight: 400;\">USTR<\/span><\/a><span style=\"font-weight: 400;\">), these economies account for 99.4% of U.S. imports.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These new tariffs have been expected in some form since the <\/span><a href=\"https:\/\/siships.com\/blog\/supreme-court-rules-against-tariffs\/\"><span style=\"font-weight: 400;\">Supreme Court<\/span><\/a><span style=\"font-weight: 400;\"> struck down the similar IEEPA tariffs earlier this year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For importers, the impact will depend on the product\u2019s country of origin and eligibility for an exemption. There are a number of <\/span><a href=\"https:\/\/ustr.gov\/sites\/default\/files\/files\/Press\/Releases\/2026\/FLIP%20301%20Investigation%20Final%20Action%20FRN%207-23-26%20FINAL.pdf\"><span style=\"font-weight: 400;\">products exempted<\/span><\/a><span style=\"font-weight: 400;\"> from the Section 301 tariffs including \u201craw materials\u201d and \u201cproducts that cannot be grown or produced\u201d in the United States alongside \u201cproducts that could cause economy-wide disruptions if subject to additional tariffs.\u201d<\/span><\/p>\n<h3>Why Were the New Section 301 Tariffs Imposed?<\/h3>\n<p><span style=\"font-weight: 400;\">Section 301 of the Trade Act of 1974 allows the United States to respond to foreign government practices that are considered unreasonable or discriminatory and that burden or restrict U.S. commerce.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At President Trump\u2019s direction, USTR investigated 60 economies regarding their failure to impose and effectively enforce prohibitions against importing goods made with <\/span><a href=\"https:\/\/apnews.com\/article\/trump-tariffs-forced-labor-8ea8114c6893a6062cf1addc3518660b\"><span style=\"font-weight: 400;\">forced labor<\/span><\/a><span style=\"font-weight: 400;\">. USTR ultimately determined that these practices were actionable under Section 301.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The tariffs are broadly based on each economy\u2019s policies and enforcement; not on whether an individual shipment has been proven to contain forced-labor inputs.<\/span><a href=\"https:\/\/ustr.gov\/about\/policy-offices\/press-office\/press-releases\/2026\/july\/ustr-takes-action-forced-labor-section-301-investigations\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/a><\/p>\n<h3>What Section 301 Tariff Rates Apply?<a href=\"http:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-scaled.jpg\"><img loading=\"lazy\" class=\"alignright wp-image-6186 \" src=\"http:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-768x1024.jpg\" alt=\"\" width=\"457\" height=\"609\" srcset=\"https:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-768x1024.jpg 768w, https:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-225x300.jpg 225w, https:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-1152x1536.jpg 1152w, https:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-1536x2048.jpg 1536w, https:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-1144x1525.jpg 1144w, https:\/\/siships.com\/blog\/wp-content\/uploads\/2026\/07\/yoav-aziz-I_dhwK3v9Jk-unsplash-scaled.jpg 1920w\" sizes=\"(max-width: 457px) 100vw, 457px\" \/><\/a><\/h3>\n<p><span style=\"font-weight: 400;\">The final action establishes several tariff treatments:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A 10% additional tariff applies to goods from 17 economies that have adopted, partially implemented or committed to implementing forced-labor import restrictions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For goods from the European Union and Taiwan, the Section 301 duty generally brings the combined Most-Favored-Nation (MFN) and Section 301 rate to 10%.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For Japan, South Korea and Switzerland, the combined rate generally reaches 12.5%.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Goods from the remaining investigated economies are generally subject to an additional 12.5% tariff.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Exemptions and the In-Transit Provision<\/h3>\n<p><span style=\"font-weight: 400;\">Not every product from a covered economy is subject to the new tariffs. Exemptions include informational materials, qualifying donations, accompanied baggage and products already subject to certain <\/span><a href=\"https:\/\/www.cbp.gov\/trade\/programs-administration\/entry-summary\/232-tariffs-aluminum-and-steel-faqs\"><span style=\"font-weight: 400;\">Section 232<\/span><\/a><span style=\"font-weight: 400;\"> tariffs, which affect steel and aluminum.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Qualifying goods from Canada and Mexico entered duty-free under the <\/span><a href=\"https:\/\/ustr.gov\/trade-agreements\/free-trade-agreements\/united-states-mexico-canada-agreement\"><span style=\"font-weight: 400;\">United States-Mexico-Canada Agreement<\/span><\/a><span style=\"font-weight: 400;\"> are also excluded.<\/span><\/p>\n<h3>What Should Importers Do Now?<\/h3>\n<p><span style=\"font-weight: 400;\">Importers should confirm the country of origin and Harmonized Tariff classification for each product, identify the correct Chapter 99 reporting number and determine whether an exemption applies. Remember that origin is based on where a product was manufactured or substantially transformed, not simply where it was shipped from.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Businesses should also recalculate landed costs, review supplier agreements and Incoterms, and maintain documentation supporting classifications, origin determinations and claimed exemptions.
